Dear Assemblyperson Pan,

I represent the California members of the Canary Party, a political action committee dedicated to health freedom and choice in medicine.

Our members vehemently oppose AB2109.

AB2109 would require parents who wish to exercise their philosophical exemption rights to first consult with a medical practitioner. This is an unnecessary intrusion into the rights of parents.

Parents currently have the option of the Philosophical Exemption Law (also referred to as the Personal Belief Exemption), which ensures they do not have to vaccinate their children if it is against "their personally held beliefs".  Personally held beliefs include religious and spiritual beliefs, as well as conscientious and moral beliefs. 

The state does not have the right to interfere with, question, add obstacles to, or regulate a closely held belief that is protected by law.

Furthermore, requiring parents to seek out and pay for a consultation with a medical practitioner is an unfair and unnecessary burden to families. Many families see alternative practitioners such as Naturopaths, Homeopaths, Chiropractors and Acupuncturists, who are not permitted to sign these forms under the rules of AB2109. Thus, these parents would be required to pay to see medical practitioners that they have already chosen not to use. This is an offensive and costly intrusion into their lives, and a violation of their right to make their own medical and healthcare decisions.

This law will create an unfair financial burden to families at a time when few can afford any additional expenses. Numerous resources exist regarding the risks and benefits of vaccines, and about infectious diseases, and are readably available in libraries and on the internet at no cost. Parents should not be forced to seek out additional and unnecessary medical coercion forced upon them by the state.

In closing, we believe this bill is a tactic being initiated by pharmaceutical and medical lobbyists, who have made substantial contributions to CA state legislators, to increase their profits without regard for the law, parental rights, parental beliefs, or the health and welfare of California’s children. 

We respectfully request that you immediately withdraw AB2109.

Thank you everyone for your support! We need to fight this outrageous attack on our most fundamental rights. Please keep up the calls and letters to Assemblyperson Pan. He is required by law to forward your letters to the Health Committee. Let him know how you feel about his attempt at limiting your rights. And ask your friends and family to call and write as well. We need every voice in this fight!

Thank you! I am in full agreement with this letter. I would also respectfully ask Assemblyperson Pan to consider where the epidemics of life shortening and often life-threatening immune dysfunctions of allergy and autoimmunity in our highly vaccinated children are coming from, and note that, here on the ground, there seems to be a strong correlation between these conditions and learning disability in our children.

Assemblyperson Pan, please consider instead promoting the neglected research of the health of never-vaccinated populations compared with our fully-vaccinated children. Such research may begin finding the answers to many chronic health conditions and profoundly improve the quality of life for all of us.

Parents should have the freedom to decide what is best for their children when it comes to vaccinations without bullying such as this. This is nothing more than a thinly veiled control tactic!

I wish legislators would for once work to increase individual freedom of their constituents instead of continually trying to further regulate, limit, and control their free choices. When parents go to the trouble to not vaccinate, they are usually pretty well informed about the reasons why.

There is a reason people refuse one size fits all vaccines.The main reason is because they have a history of being dangerous, and as a parent I try to keep my children safe. Please, while you are trying to inject all children with vaccines please read what's in them and their safety record, after all you wouldn't put something in your car that might damage it, why do you want us to put something in out children that may damage them.

Please withdraw this bill immediately...it places a burden on both parents and doctors and is completely unnecessary. A parent's right and educated decision regarding vaccination should not be questioned.

It has generally been shown that those of us parents whom choose to not vaccinate have researched the topic thoroughly and stay on top of new information. Waivers are our right, and should not be questioned. This puts doctors in a difficult position with potential liability, as well.
